The Arizona Board of Regents is giving DREAMers in-state tuition at the state’s three public universities. A Tuesday ruling by a Maricopa Superior Court Judge siding with DACA recipients influenced their decision.
Scholarships A-Z, an advocacy group for DREAMers who has been at their side in this years-long fight, sent out this press release:
We as ScholarshipsA-Z, along with other community organizations and supporters across Arizona, applaud the Arizona Board of Regents for making the right decision. By choosing to comply with the law and charge in-state tuition to DACA recipients, the doors to Arizona’s 3 public universities are opened wider. This decision from the ABOR means that talented individuals across Arizona will now have the opportunity to attend or transfer to exceptional universities.
“As a DACA recipient and current student at Pima Community College, I feel at ease to know that I will be able to attend the University of Arizona with instate rates. Today was a victory for all DACA recipients led by the collective efforts of ScholarshipsA-Z, Arizona Dream Act Coalition, Arizona Dreamers in Action, No More Deaths Flagstaff, ASU Graduate & Professional Student Association, and countless supporters across the state. We are in this pivotal moment because of DACA and undocumented students’ courage to share their stories, and remind us that education is a right for everyone. Arizona’s colleges and universities are matching their courage with the decision to grant instate tuition to DACA students.
“We know that this decision is a victory. However, we know that it will only affect those individuals that have been granted DACA. ScholarshipsA-Z is committed to working with ABOR to implement this change to the fullest extent, at all 3 universities. We encourage DACA students across the state to reach out to take advantage of this moment. ASU, NAU, and UA are options for DACA students to attain a higher education.
ABOR sent this statement:
“The board remains committed to affordable access to higher education for all eligible students. The board is also committed to compliance with state and federal law.
The Maricopa County Superior Court has ruled that a Deferred Action for Childhood Arrivals recipient who represents an Employment Authorization Document and who meets Arizona law residency requirements is eligible for resident tuition. (State of Arizona v. Maricopa County Community College District).
The Board of Regents will interpret its policies in accordance with this ruling. This will allow DACA students with an Employment Authorization Document who meet the statutory and policy requirements for residency to establish in-state residency tuition purposes at our Arizona universities.”
Congratulations, DREAMers. This is historic.

Hey… my grandma was technically a dual citizen of (AZ), USA & Mexico. Her family had escaped to the Mormon colonies south of the US/Mexico border. While there her records of birth… proof of her parents US citizenship were destroyed in a fire. Later when she was teaching school in Mesa, Az a new policy was requiring that all school teachers put their birth certificates on record so they could teach. Of course she couldn’t do that. A family friend & clerk in the county understood her dilemma & forged her a birth certificate saying that she was born in Douglas AZ instead of Morellos, MX where her birth had been…. (in a tent). She was scared to death to step foot into MX after that…. figured she would be stuck down there. So you know I understand that folks are in a dilemma … the dreamers especially have been? I know that this will attract a lot of hatred to say this but I feel for the dreamers…. I also think empathy is a good thing. It can bolster & improve a society… These dreamers can go on to get an education & then they will contribute to AZ or anywhere in the US. I think it’s short sighted to resent their being educated for the betterment of the whole society. I find that resentment kind of backwards & oafish really. So I guess here comes the hate rattles now that I’ve said this…

So tell me, why should she get in-State tuition? Why does she deserve such a reward?
What about all the students that are citizens by birth, but from another State, who must pay out of State tuition.
Moreover, the Maricopa County judge referred to a federal law and claims it preempts any State law.
First, DACA is an Executive Action, not a Congressional Act; therefore, it is no law at all.
But more importantly, the Department of Homeland Security DACA page, deferred action does not provide lawful status.
“On June 15, 2012, the Secretary of Homeland Security announced that certain people who came to the United States as children and meet several guidelines may request consideration of deferred action for a period of two years, subject to renewal. They are also eligible for work authorization. Deferred action is a use of prosecutorial discretion to defer removal action against an individual for a certain period of time. DEFERRED ACTION DOES NOT PROVIDE LAWFUL STATUS.” emphasis added
The Judge got it wrong and he should be impeached for getting it so terribly wrong.

Actually, there is a huge difference between immigration in 1822 and today. Immigration was handled by the States and as long as the nation of origin was a ‘friendly’, there were essentially no rules.
Today, the Feds has usurped control of immigration and you see how that has worked out for us.

Finally some good news for Arizona’s Economy! These young men and women are going to blossom into amazing citizens, they are going to earn good money and most importantly they are going to pay taxes! This is an investment in our future!
My guess is that these young men and women will on average pay more in taxes over their lives than the “head in the sand” idiots who oppose this type of solution.
They are already better Americans than the people who want to prevent them from being Americans. Take that haters.

Read the above article for those of you who really believe that the Dreamers should not have been allowed to go to school for in-state tuition. Yes it was written in 2011 and it is still important information today… probably even more so judging for so many comments. It is not about the Dreamers but rather why the GOP has systematically taught people like you how to hate as a distraction to what they did and do. Some of you are just trolls so it doesn’t matter.
