Republican Martha McSally led Democratic Congressman Ron Barber by 133 votes after Pima County completed a new batch of votes today.

But the margin is within the 200-vote threshold for a recount, so the race isn’t quite over yet.

The recount is just the latest twist in a rematch between two candidates who were separated by less than 2,500 votes in 2012.

Pima County spokesman Mark B. Evans tells the Weekly that there are roughly 200 ballots left to count.

McSally expressed confidence that she would win the race.

“No doubt this has been a long process for everyone involved and we are grateful for all the support and encouragement we’ve seen,” McSally said via an emailed statement. “There are still ballots left to count, but we are confident that when all ballots are in, our lead will hold. We will continue to provide oversight of the process until then.”

But Barber spokeswoman Ashley Nash-Hahn said the race remained “too close to call.”

“This is the closest congressional election in Arizona history,” Nash-Hahn said via email. “The law calls for an automatic recount in a race this close, and that is where we are headed.”

She also suggested that Team Barber might take legal action to get provisional ballots that were tossed out by the Pima County Recorder’s Office included in the recount.

“We remain committed to protecting the integrity of the vote in Southern Arizona,” Nash-Hahn said. “In Pima County, 782 voters had their ballots rejected, and those votes have not been counted. During the legal recount process, we will work to see that every lawful vote is counted and that the voices of Southern Arizona are heard.”

    I think I see how the Dems have administered fraud by using poll workers and provisional ballots. There really are no rules that disqualify them, if handled by the “right” poll worker.

    Something similar was done at DMV. Remember?

  5. The election officials disqualified many ballots that were proven to be submitted by illegal aliens. All of which, no doubt were sent over by Raul Grijalva’s ofc. and were probably going for Barber. All of these Demorats are pathetic liars and cheaters but some are even more disgusting.   8. Watching this from Maricopa it seems like a comedic tragedy. McSally talks legal action and she’s childish, selfish or whatever. Now Barber wants to go to court and that’s o.k.. It seems like he already got his way when the judge ruled against her. If the same judge rules for him on the disqualified ballots (his attorney was there for them) then we’ll see how the fix is in down there. I’d rather have a Rep part of a big majority in the House than one who will be part of a non essential minority. Just imo.

  9. 133 votes is no land slide win!:-) At best in a low voter turn out mid term election she benefited from a low voter turn out apathy, which cannot sustain a career in a democrat dominated part of Arizona, she is a one term person if she wins, guess we have to wait for the official declaration of her win and not from the racist Mexican flag burner peanut gallery!:-)

  11. The fundamental difference between McSilly’s legal action and Barber’s potential legal action is that she is attempting to suppress the vote and he is attempting to make sure that every valid vote counts.

    Her action is straight out of the Republican playbook. They’ve gone to great lengths in many states around the country to suppress the votes of black, Hispanic, and young voters–i.e., people who vote overwhelmingly for Democrats. This is not a crazed conspiracy theory like the crapola that gets thrown around on these comment threads by the paranoid haters (see above). It’s proven with careful research by the non-partisan Government Accountability Office and several non-partisan non-profit voting rights groups.

    The reason the Rs want to suppress votes is because there is an inexorable demographic shift underway in this country that threatens to render the Republican Party impotent and irrelevant, as those demographic groups continue to make up a larger and larger share of the electorate. The Rs can’t win those votes, because their policies consistently punish those demographic groups, so the only way they can keep winning elections is to suppress those votes.

    And that makes the Republican Party about as un-American as you can get.

Thank God Pima County is not Maricopa County at least we do not have right wing domination, do some stray right wingers get elected in these off season, mid term elections sure we do, but they have no land slide victories, and more often than not end up like Russell Pearce and his clan biting off more than they can chew and end up history! The state is a divided electorate in general, 34% +/- republican, 31% +/- democrat and remainder 35% +/- independent and minority parties, demographics is the doom of the ne’r to do wells who have migrated to Arizona to dream of their race wars, practice their racism, they simply will fade into the wood work eventually! Time and birth rates will send them into history here in Arizona like the dinosaurs!

  19. Skinnyman, I’m not sure which election you were watching last Tuesday, because it sure as hell wasn’t the same one I saw. There’s absolutely no logic to anything that you said. McSally was justifiably concerned that some of the provisional ballots were invalid, which could be due to a number of reasons. I know you guys on the left think all Republicans simply hate Mexicans and illegal immigrants, but the reality—like it or not—is that this state has very real issues regarding fraudulent voting by non-citizens, and challenging said votes doesn’t make McSally a racist.

    However, Barber’s threat of legal action should he lose the recount is just bad sportsmanship, plain and simple. This garbage about making sure “every valid vote counts” (the key word being *valid*) is a straw man argument intended to stir up the liberal base and convince uninformed Hispanic voters that McSally and Republicans are trying to suppress their votes out of hate, spite, etc. And I’m sorry, but your argument that Republicans “have gone to great lengths in many states around the country to suppress” votes simply doesn’t hold water. I watched carefully for any reports of “voter suppression” and—aside from a report alleging that La Raza was telling illegals where they could go to vote (illegally)—there was absolutely nothing of significance reported by ANY news source.

    The truth of the matter is that Barber originally won his seat largely as a result of the “sympathy vote” in the wake of the Tucson shooting that left Gabby Giffords seriously injured. Even though southern Arizona tends to lean to the left, CD2 has traditionally been a pretty competitive seat, and it was an extremely close race the last time these two butted heads as well. The peoples’ dissatisfaction with the direction of the country under Democrat leadership, as well as an excellent turnout for Republicans, both contributed to this slim margin of victory for McSally.

    Let’s drop the left-wing talking points and stick to reality. Barber lost, McSally won. End of story. But hey, if Barber wants to waste everyone’s time and money attempting to litigate his way into office, it’s his funeral.

The problem with your assertion is that there is really no clear definition of “voter suppression” as it applies to modern-day elections (at least that both parties can agree on). It’s simply a partisan buzzword that Democrats like to throw around in order to support their narrative that, simply by asking potential voters to show a driver’s license to prove their identity (or other easily obtainable forms of identification), Republicans are keeping minorities, the elderly, and the poor out of the ballot box. Frankly, it’s a ridiculous and completely false allegation that is tirelessly repeated by the left.

    If you happen to see a report where a group of white people with baseball bats were hanging around a designated polling place, be sure to let me know. Don’t worry, I won’t wait up. In any case, I was referring specifically to the midterm elections. No major network, newspaper, or other media source has come forward with any reports of alleged “suppression,” either in Arizona or the US as a whole.

    Who said anything about a tidal wave of illegals? Surely you don’t deny that “undocumented migrants” do try, and often succeed, to fraudulently vote in US elections. I was referring to the few hundred votes that were thrown out in this particular race, and I’m sure many were ruled invalid for myriad other reasons. Or do you believe that the Pima County Recorder’s Office is just racist and guilty of “voter suppression” themselves?

  27. I’ve seen this before. I lived in WA State during the first Gregoire/Rossi gubernatorial election. Rossi had won. By more votes than this race. Then the recounts began. One. Two. Three. Judges ruled unsigned ballots must be counted. Unmarked ballots for governor were marked for Gregoire. Ballots were mysteriously found in pockets of voting machines. They’d been “overlooked.” A couple of boxes of ballots were found in the trunk of a car. Gregoire kept losing but the DNC kept paying for more recounts and suspect ballots kept appearing. Democrat-appointed judges kept tweaking the rules. By Recount Number Three, Gregoire had “won.”
    The very weak RNC in WA did not sue.
    McSally I hope will be different. If not, she can say buh-bye. The Democrats WILL commit fraud.

    I would argue that McSally is attempting to do the EXACT same thing, and we’re just having a semantic debate over what a *valid* vote is. There was a legitimate debate as to whether provisional ballots needed to be signed by a poll worker in order to be considered valid. The AZ SoS Election Procedures Manual was unclear and at times contradictory (and yes I read it).

    While I think Barber’s team makes a decent argument that the poll worker signature isn’t mandatory, that’s up to a court to decide. To my mind, to ensure a fair election, ANY questionable ballots should have been kept segregated until a court does rule on that, but there were high burdens and the law’s the law.

    I also got a huge kick out of Ann Rodriguez’s claim that the sole reason for McSally’s challenge was “that the ballot should still be disqualified solely because the poll worker FORGOT to also sign the provisional ballot form.” She should get a reality show! Maybe called “Psychic Recorder” since she knows exactly why a required signature was missing: The poll worker FORGOT. I’ll admit that it’s *probably* because of poor training/selection of poll workers, but it’s at least a remote possibility that the signature omission was intentional for some reason I can’t speculate about. I won’t pretend to know…the Recorder shouldn’t either.

    But to address your quoted claim that Barber is a saint fighting to get EVERY single darn valid vote counted and McSally is an evil vote suppressing tool of the Koch Brothers/Tea Party/John Birch Society/Trilateral Commission, etc. etc. etc. trying relentlessly to subvert the will of the people I want to address a point.

    According to the court filings for the TRO, Cochise County disqualified provisional ballots that lacked poll worker’s signatures. I don’t see Team Barber demanding that these votes now be counted as well, do you?

    I’m expecting the announcement momentarily. 🙂

    Should Team McSally (or better yet, the voters themselves) try to get those Cochise County ballots counted (perhaps in an attempt to push the margin outside of 200 votes) its going to be very entertaining watching Team Barber’s legal contortionism to now oppose it.

    This has been one hell of a fun ride and it ain’t over yet.

  29. It is interesting to note the anger and frustration in most if not all of these replys. Perhaps we should remember that Ronald Regan said “Government is the Problem” so perhaps we are all wasting our time voting at all. The really amazing thing to me is that most people vote against there own best economis interests. Its no question that the american people are angry. But why could it be that we are no longer a Democracy and at best mabby 50%. It is evident that the ratings of congress are at the lowest level since the data were began. The real enemies of democracy are the people who have the most to gain, the few at the top. Do not be confused; the media and the money are forever vigilant. consider this 13 billionares put up the money for this election. Does this sound like a democracy. It is a known fact that if you repeat a lie enough people will believe it. Look what happened in Iraq . When are people going to wake up to the fact that the military industrial complex runs this country as Peresident Eisenhower said in his last speach. There is very little difference in the two parties. The so called wedge issues were put in place by some very smart people to create conflict and anger so that the people who really run this country can do what they want FOR THEIR OWN ECONOMIC BENEFIT. As the voters continue to throw mud at each other; the people at the top who run this country are smiling all the way to the bank.

    All valid votes in Cochise should count as well, and yes, McSally should be fighting for that, if she has half a lick of sense. But instead, she takes the usual punitive Republican approach of trying to throw out votes in Barberville. You can ignore reality on this matter as much as you like, but it’s a proven fact. Indeed, some Republicans even admit it outright–lots of quotes from Republicans specifically objecting to “making it too easy for blacks to vote” and that sort of thing. Look it up! In Ohio, Republican election officials extended early voting hours in overwhelmingly white precincts and curtailed them in overwhelmingly black precincts, until a massive public outcry forced them to backpedal a bit. This kind of thing has happened in many other states as well.

    Look folks, to me this isn’t really about who wins at this point. It’s about the sanctity of the process and erring on the side of counting as many votes as legally possible, no matter whose “territory” they’re in. Judges consistently come down on the side of discerning and preserving voter intent, which is why votes that get thrown out on technicalities are often reinstated. The fact that Republicans are generally the ones trying to trash those votes is one key reason why Democrats tend to benefit when those votes are reinstated and counted. Not a conspiracy, just a fact.
