While hemp-derived products with trace amounts of THC were legalized under the 2018 Farm Bill, that era has come to an end after the latest government funding package was passed earlier last week. Hemp-derived products with 0.4 milligrams of THC per container, will be banned when the law goes into effect next year. 

Since 2018, the hemp industry has ballooned into a multibillion dollar industry. As long as a hemp-derived product contained 0.3% or less of delta-9 THC, it could be sold legally.  

Hemp-derived products could be purchased at gas stations, convenience stores and online retailers. Kentucky Senator Mitch McConnell was vocal about closing the loophole, and aimed to use the new spending bill to do so. Because over half of hemp grown in the U.S. is grown in Kentucky, there could be major blows to the state’s agricultural industry.

At a larger scale, the U.S. Hemp Roundtable, a hemp advocacy group, warned that the ban could impact over 300,000 jobs.

“We have lost the battle this time,” Jonathan Miller, the U.S. Hemp Roundtable’s general counsel said in an interview with CNBC.

“In effect, this is a total, all out, complete ban on hemp products in the United States,” Miller continued. 

Until the law takes effect, the hemp industry has time to pivot and prepare. This will likely be done through pushes for widespread regulation, like age restrictions, federal testing, and labeling, instead of an outright ban.
