Dammit, every time I think I’m done writing things about Amy’s Baking Company, they pull me back in.
According to Consumerist (via Radar Online), apparently those wacky Bouzaglos are at it again (or, perhaps, remain at it), as they allegedly make their employees sign a contract prior to employment.
As one might assume, this contract appears to have been written by people who don’t understand how the real world works, as it includes terms that seem…a bit harsh for working in a damn restaurant.
For instance (and note that everything in blockquotes can be considered [sic]’d right off of the bat):
5). Any attitude will result in immediate termination.
Well, I guess that’s why poor waitress Katy Cipriano was fired instantly after asking Amy a question. READ THE CONTRACT, SUCKER.
17) The recipes and techniques that have been developed by Amy at ABC are exclusive and shall remain confidential. Any removal of recipes will be considered theft.
Considering that “America is about “ressling” as the Bouzaglos put it a few months ago, I’m not certain that they’ve got much to worry about regarding recipe theft.
20) By signing this contract, you are hereby accepting that you will be employed exclusively by ABC Amy’s Baking Co. LLC. And shal not work for any competitor within a 50 mile radius of ABC within one year of termination or voluntary Resignation, without prior authorization from ABC. Amy’s Baking Co LLC.
ahahahah what
So we’re clear, that would mean that you’d be unable to work ANYWHERE in the Phoenix metropolitan area.
Your closest job opportunity within the food industry would probably be the In-N-Out Burger in Casa Grande — no jumping ship across the strip mall for you!
There’s so, so much more to it — but I can’t share more with you for fear of my brain collapsing in on itself in an attempt to understand the madness.

Who in their right mind would work for these people? You’d get more respect working at McDonald’s or Walmart than these people will ever give you!
This business has to be a front of some kind because there’s no other logical explanation as to how they remain in operation. The ways in which customers and employees are treated at this establishment are above and beyond pathetic. I truly cannot imagine that there are that many individuals out there who look forward to any of the BS the Bouzaglos dish out quite frequently. I personally would not have given them another try as a customer or any more than interview time as a perspective employee had I been faced with any of these shananigans.
Then again, maybe the customers and employees are there for the show and not the meal or the employment. If that is the reason, then they are a way more patient and tolerant bunch of individuals than I will ever aspire to be.
Presumably they requested assistance of Chef Ramsay because they were in a lot of trouble and unable to remain in operation much longer. If this is so then I surmise that what is keeping them open is the publicity (and until last month the tourists), since any publicity however bad is better than no publicity. I also surmise that if Ramsay had better understood the reasons behind the reasons for their failing status, he never would have gone there in the first place (though of course, since this is “reality” tv, nothing is beyond the pale).
@ J_in_Cochise: I didn’t think to consider the good point you made in your post. They probably are in danger of losing their business and that’s why they agreed to have Chef Ramsay assist them.
The Bouzaglos sure haven’t appeared to have learned anything from the Chef Ramsay experience though. I haven’t investigated this all too thoroughly, but I imagine their employee turnover rate is SKY HIGH.
Non-competes have all but been disqualified in court. One cannot limit the employment opportunities of a person as it would cause economic hardship.
It differs if you have access to proprietary knowledge but food employee would not fall under that auspice.
This is Arizona, where the employer knows they can get away with almost any amount of dishonesty, defamation, or abuse towards the customer or employee. No legal protections will apply (except for the employer). Where is the labor dept and protection for the workers? – nowhere to be found. This scenario is destined to repeat if there is no intervention or strengthening of AZ law, a company like ABC will likely be hailed as a legal role model for other Scottsdale establishments to follow.
they are still gettin’ away with it…
Hey “tasgawi”…if you don’t like AZ, you are free to leave, just like any job. And frankly, if you have nothing to add to the place, we don’t need you here. All radical liberals, please go back where you came from, Tucson “Used” to be a great place to live.
It looks like Amy’s has at least one admirer of their practices here in Tucson – cempiremtn . If “radical liberal” means supporting human decency and respecting the law, I would think cempiremtn should be the one to leave. Tucson is a great place and could be even better without hate and disrespect for law and human rights.
I hope you’re well armed and living in a defensible canyon “cempiremtn” because the right-wing hell that Arizona will become when the “radical liberals” all leave will be hard to survive if you’re not…
I would love to see a copy of that contract posted.

I sincerely hope they did not pay someone to draft that mess for them. It is absolute amateur night
