Didn't Get Lucky

A man scaring people with a toy gun was caught carrying drug paraphernalia "just in case" he were to happen upon any drugs, according to a Pima County Sheriff's Department report.

Sheriff's deputies heard reports from several drivers on the south side that a man was at the side of South Cardinal Avenue near Valencia Road "holding a gun, waving it around, flashing it and pointing at traffic." One witness described the gun as "possibly a semiautomatic" and said the subject was holding it with two hands.

When one deputy found him, the man turned around laughing and said, "I bet somebody called about me holding this," referring to the gun in his hands—which the deputy could immediately see wasn't real. Said his report: "It did not even appear to be a similar looking toy or BB gun or Air Soft gun. It was a broken plastic gun which appeared to be a rifle and was disproportionately small for the rifle that it was mimicking."

The man told the deputy he'd found the broken toy gun on the ground as he was walking home, admitting "it probably was not a very good idea" to be moving it around with his hands in plain sight of traffic—but he said he'd only been trying to fix it.

The man readily identified himself to two deputies and emptied his pockets for them—at which point they found he'd been carrying a lighter, a hollowed-out pen and some foil, traditionally used for smoking methamphetamine or heroin.

The man wasn't apparently high but said he habitually carried the foil and pen on the chance that he'd encounter someone with drugs to give or sell him—in his words, "just in case he got lucky."

Deputies confiscated the pen and foil and cited him for possession of drug paraphernalia. They released him after taking the toy gun to prevent him from further frightening passers-by.
