Maybe He Was Flirting

San Xavier Beat, Nov. 7, 2:05 p.m.

An adolescent boy insisted on invoking his rights to a lawyer upon being arrested for "pouring a bottle full of urine ... on a girl's head," a Pima County Sheriff's Department stated.

Two sheriff's deputies were called to a west-side middle school, where the assistant principal told them a 13-year-old boy had been in possession of a plastic Pepsi bottle containing urine, which had splashed all over several of his peers when he'd dumped it on a female student.

The victim told the deputies "she had no understanding" of why she's gotten pee thrown on her—she knew who the subject was, but she "did not talk to him or hang out with him whatsoever."

A witness of the incident said he'd seen the subject approach the female victim and some other students and say, "I'm going to throw urine on you," at which point a boy in the group said, "No, don't do it!" and put up his hands to block the bottle full of pee. But the subject threw the bottle anyway.

One deputy interviewed the subject where he was being held in an administrative office. After reading him his Miranda rights, the officer directed him to explain what had happened; the boy simply said he'd found a bottle of urine and threw it on a girl "because she was annoying him."

Asked how he knew it was urine, the student said he'd found the bottle in the bathroom—and, presumably, it looked like urine. (In any case, the student was implying, it was not his own urine.)

The deputy then demanded to know "how he determined the planning (of the incident), who planned it, and who was involved"—at which point the subject said he "wanted his lawyer" and stopped talking.

The pee-pitching young man was handcuffed and taken to the Pima County Juvenile Detention Center, where he was booked for three counts of disorderly conduct and three counts of assault, both class 1 misdemeanors.
