On the taxation side, there is an ongoing case in Northern California, with the plaintiffs taking the position it was not Congress's intent that IRC 280(e) apply to state legal businesses. Unofficially, there are many IRS employees hoping the plaintiffs win.

The Republicans have been foolish and divided. With seven years to craft a replacement, they did nothing. However, at the end of the day, this may turn out to be a good thing.

The ACA was designed to fail under it's own weight. Of course, the Democrats thought that they would still be in charge when that happened, and could shove single payer down our throats.

What should happen now is to let the ACA fail, as it was designed to, and then craft a minimal set of changes to the law designed to force the healthcare industry to right itself. There will be weeping and wailing and knashing of teeth by the industry, but they will adjust. We can not continue to feed the beast.

There are no easy answers, and the concept of balance is very subjective, and is a moving target. Both sides of this debate are like Chicken Little, saying the sky is falling if they don't get everything they want.

I am not a fan of commercial development, and love my wilderness areas, and the solitude it brings. However, I am able bodied and can get into those areas without a problem. They way some of these Acts are implemented, they deny the ability of anyone else from enjoying these.

I am a CPA who has given multiple seminars on the marijuana industry, including the accounting and taxation thereof.

In late April, I laid out the legislation needed to fix this problem, even the wording needed to exempt state legal businesses from the provisions of IRC 280(e), and also from the purview of other Federal Agencies such as ATF, etc. But, leaving those provisions in place as tools against the cartels and other major players. I asked Congresswoman McSally to forward to the proper committees.

Congresswoman McSally's office has not responded. I have also sent her correspondence concerning the Civil Forfeiture issue. Again, no response.

What frustrates me the most about this is that I have been a diehard supporter of hers, both financially and otherwise, since her first run for Congress.

I am a CPA with several restaurants/bars as clients, Yes, they have all had to raise prices. It is not an exact science, though, on how much to raise them, and selectively on which items.

Those who want to slam the establishments and owners for raising those prices have NO clue, that most are not that profitable and that the owners and their families many times are still in the EITC range of income on their tax returns. Just because you own your own business doesn't mean you are wealthy or even making a good living.

However, on the flip side, several of my clients who are bartenders/waiters/waitresses have said that for the first time, they are actually getting paychecks for more than $0, and haven't had to disgorge some of their tips to pay the Social Security/medicare on their tip income.
