same thing holds true if you're high on any other drug, slumped over in your car -

You do not have to be actually caught in the act of driving to be charged with DUI. If police have reason to suspect you WERE driving drunk (in "actual physical control" of the vehicle)--i.e., found on the side of the road, alone, with your vehicle--you can also be charged.
Yeah, Kynn, I thought exactly the same thing. I know if one is drunk and inside the car that's one thing. But according to the article:
"Deputies responding to a report of a "suspicious" parked car found it on the side of Ajo Way—with an obviously drunk man slumped against it."
I would think he could be arrested for "public intoxication" but not DUI.
Huh. Why'd he get a DUI if he was pulled over on the side of the road and not driving?
Also really tragic insight into the under belly and parts of our society and a really scary portrayal of what police officers have to deal with day in and day out - God love you!

My only question is what public service is served by taking the pot smoking man to jail unless he was the cause of the accident? I don't question the deputies' judgement, thank you deputies for the job you do. I question the laws that say if you possess so-called illegal drugs, you have to stay at the Pima County Jail at MY expense. Deputies should only take pot man to jail if he's disturbing the peace, otherwise let them seize bong and residue and issue a ticket for intoxication as you would a drunk person. No wonder our city, county, state, and federal govt are so broke and desperate. Send dealers to jail, not mere users causing no harm to themselves or others.
